1. Introduction

These Terms and Conditions (“Terms”) govern the use of services, courses, and products provided by Thai Ocean Academy (“we,” “us,” or “our”). By booking a course, purchasing equipment, or participating in any of our activities, you (“customer” or “participant”) agree to comply with these Terms. Please read them carefully before proceeding.

2. Services Provided

Thai Ocean Academy offers scuba diving courses, fun dives, try dives, marine conservation programs, and equipment sales and rentals. For more information on specific marine conservation programs, please refer to our pricing page.

3. Booking and Cancellation Policy

• Free Cancellations: Cancellations made at least 7 days before the scheduled activity are eligible for a full refund or store credit.
• Partial Refunds: For cancellations made less than 7 days before the scheduled activity, a store credit will be offered, unless otherwise agreed upon, in which case a refund may be granted.
• Rescheduling: Rescheduling requests are subject to availability and must be made at least 48 hours in advance.

4. Payment Terms

• A deposit is required at the time of booking to secure your reservation.
• Full payment must be made prior to boarding the boat for dive trips.
• For equipment purchases, a deposit is required to confirm the order, and full payment is required before the product is received.
• We accept major payment methods, including credit cards, bank transfers, and PayPal.

5. Participant Requirements

Participants in all diving activities must meet the minimum requirements as outlined in the RAID General Diving Standards under the “Pre-Requisites” section for each program. These requirements vary by course.

• All participants must complete a liability waiver prior to any scuba diving activity. Failure to sign or complete this form will result in the cancellation of the activity without refund.
• Participants must ensure they are physically fit for diving and provide accurate medical information during registration.

6. Equipment Rentals and Sales

• Rental Equipment: All rental equipment must be returned in the same condition as provided. Damage, loss, or failure to return equipment will result in repair or replacement fees.
• Sales: For equipment sales, full payment is required prior to delivery of the product. All sales are final, except in cases where a product is defective.

7. Liability and Waivers

Diving is a physically demanding activity and involves certain risks. By participating, you acknowledge and accept these risks. All participants must sign a liability waiver before commencing any diving activity. Thai Ocean Academy is not responsible for any injuries, accidents, or losses that may occur, except in cases of proven negligence on our part.

8. Personal Data and Privacy

We collect and store personal data, such as your name, contact details, insurance information, and rental sizing information, for internal use and to provide you with appropriate services. We do not share your personal information with third parties, except as required by law or in the event of an accident.

By providing your information, you consent to its use in accordance with our privacy practices. All data is stored with appropriate protections in place.

9. Intellectual Property

All content, including photos, text, logos, and media found on our website and marketing materials, is the property of Thai Ocean Co., Ltd. You may not reproduce, distribute, or use any content without our express written permission.

10. Dispute Resolution

Any disputes arising from the use of our services or products will be governed by the laws of Thailand. Customers agree to resolve disputes in good faith, and where necessary, disputes will be referred to the appropriate legal forum under Thai law.

11. Changes to Terms

Thai Ocean Academy reserves the right to modify these Terms at any time without prior notice. Please ensure that you review these Terms periodically to remain informed of any updates.
